Terms & Conditions

• Prices quoted are in Euros and are payable by Visa, Mastercard or cash. Payment can also be made via direct credit into our bank account, with bank details being provided on request. Any bank fees incurred when payment is completed will be your responsibility.

• The balance of the tour price is payable 60 days prior to departure and payments must be made in Euros.

• A 2% surcharge is applicable on payments made by credit card

If you wish to cancel your tour, you must notify the Operator in writing. Once your notice is received, the cancellation will take effect subject to the following:

• If cancellation occurs outside 60 days of the departure date you will forfeit your full deposit.

• If cancellation occurs between 60-30 days prior to departure you will forfeit 50% of the tour price.

• If cancellation occurs within 30 days of departure you will forfeit 100% of the tour price.

The Operator reserves the right to cancel any tour prior to departure for any reason whatsoever in which case you will be given a full refund of payments which you have made to us. You will not be entitled to claim any additional amounts whatsoever or seek any compensation for any loss, expense or damage or for any loss of time or inconvenience which may result from the cancellation.

Full personal travel insurance including, but not limited to, accident, illness and travel cancellation is strongly recommended for all of our tours to guard against the unexpected. Should travel insurance not be obtained by you, then this is completely at your own risk.

The Operator reserves the right to:

• Change the date of departure or conclusion of the tour, or, modify any aspect of the tour; or

• Cancel or modify any routes with the tour or objectives set out in the itinerary; or

• Substitute different or equivalent routes within the tour in place of cancelled or modified routes; or

• Postpone, cancel or delay any such aspect of the tour if in the absolute discretion of the Operator, it is necessary to do so due to inclement weather, snow or icy conditions or conditions that are otherwise likely to be hazardous or dangerous or due to any other adverse or threatening conditions which may affect the safety of participants and guides of the group.

• To fully benefit from and enjoy the Tour you should be in good health and physical condition.

• If you have a medical, physical or mental condition you must disclose this to the Operator upon booking. You are also obliged to disclose any medical condition which becomes evident once you have booked leading up to departure of your tour.

• Despite any condition you have disclosed as required above, you confirm that you are in good health and are physically fit and have no medical, physical or other condition that could be affected by completing the Tour, including (without been an exhaustive list) the following conditions; pregnancy, high blood pressure, heart conditions, neurological disorders, previous dislocations or breaks, bone disorders, asthma or back issues.

• You understand and accept that although you may consider yourself to be in good health, that does not guarantee that participation in the Tour will not cause or lead to health issues or injuries to you. • You hereby consent to receive such medical treatment as may be necessary in the case of any injury, accident or illness incurred during or after your participation in the Tour.

If the Operator is prevented (directly or indirectly) from performing any of its obligations under this agreement for any reason whatsoever including but not limited to an act of God, strikes, trade disputes, fire, breakdowns, interruption of transport, government or political action, acts of terrorism, acts or omissions of a third party, the Operator will be under no liability whatsoever to you and may, at its option, by written notice, either cancel the tour or arrange an alternative arrangement.

You understand and acknowledge that:

• The Tour involves an element of risk and that risk exists in the use of the equipment required for the Tour and/or your participation in the Tour and includes (without been an exhaustive list) difficult and dangerous terrain, extremes of weather, remoteness from normal medical services, communications and evacuation difficulties, physical stress, dangers or hazards which may result in damage or loss of personal articles, accidental injury, illness or in some cases permanent trauma, disability or death (the “Risks”); and

• The Risks may be caused by the negligence of other participants including you. The Risks may arise from foreseeable or unforeseeable causes including but not limited to the Operators decisions, equipment failure, medical conditions or issues which you are either aware or unaware of and any other risks that are integral to the Tour and adventure activities; and

• The issues and Risks disclosed above cannot be eliminated without destroying the experience and unique character of the Tour which you want to experience even after understanding all of the matters disclosed herein; and

• The Operator reserves the right to withdraw any person including you, who in the Operator’s opinion is likely to endanger themselves or others. Any person withdrawn shall forfeit 100% of the tour price; and

• You hereby agree to adhere to all instructions and wear all safety equipment and acknowledge that the Operator reserves the right to cancel the activity or refuse anybody, including you, from participating on the basis of compromised safety.

In consideration of the Operators accepting your booking and in consideration of you being permitted to join the Tour, to the extent permitted by law, you confirm:

• After understanding all the information provided in this form, you, for yourself, your executors, administrators, successors and assigns release, waive, hold harmless and keep indemnified the Operator from all claims, losses, damages or expenses incurred during, or in conjunction with your participation in the Tour including any claims for loss or injury to a person or equipment caused by equipment failure and/or negligence of the Operator, together with any costs including legal fees that may be incurred as a result of any such claims losses, damages or expenses whether properly founded in law or otherwise.

• After understanding all the information provided in this form, you, also release, waiver, hold harmless and indemnify the Operator against all claims, losses, damages or expenses or any claim that any of your guests, companions, next of kin may have or any one or more of their executors, administrators, successors or assigns may have against the Operator including costs and legal fees that may be incurred as a result of any such claims, losses, damages or expenses whether properly founded in law or otherwise.
